Introduction and Acceptance

These Terms of Service (the "Terms") govern your access to and use of the website, applications, content, tools, and services made available by The Sport Stack ("we," "us," or "our"), operated by George Boyle, an individual based in Texas, United States. Please read these Terms carefully before using the service.

By accessing or using the site, you agree to be bound by these Terms and by the policies referenced in them, including our Privacy Policy (/privacy), Cookie Policy (/cookies), Responsible Gambling notice (/responsible-gambling), Accessibility Statement (/accessibility), and Disclaimer (/disclaimer). If you do not agree with these Terms, you must not access or use the service.

Your continued use of the service after any changes to these Terms constitutes your acceptance of those changes. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Eligibility and Age Requirements

The service publishes information relating to sports betting and is intended only for adults who are legally permitted to view such content where they live. By using the service, you represent and warrant that:

• You are at least 18 years of age, or 21 years of age or older where required by the law of your jurisdiction (as applies in many US states);
• You are of legal age to view sports-betting-related content in your jurisdiction;
• You are not located in, or accessing the service from, a jurisdiction where doing so would be unlawful; and
• You have the legal capacity to enter into these Terms.

Sports betting laws vary widely by country, state, and locality. You are solely responsible for determining whether accessing this content and engaging in any sports betting is legal where you are located, and for complying with all applicable laws. We make no representation that the service or its content is appropriate or available for use in any particular location.

Description of the Service

The Sport Stack is a data-driven sports analytics website covering Major League Baseball (MLB), the National Football League (NFL), college football, professional tennis, and mixed martial arts (MMA). The service publishes model projections, "best bets," player-prop edges, line-shopping boards, and a public track record (including ROI, units, and win/loss records) of the operator's own previously staked plays.

The service is provided for informational and entertainment purposes only. To be clear about what the service is not:

• We are not a sportsbook, bookmaker, betting exchange, or gambling operator;
• We do not accept, place, broker, solicit, or facilitate any wager or bet;
• We do not handle, hold, transfer, or escrow betting funds of any kind — no deposits, no bankrolls, no stakes, no payouts. The only money that ever passes between us is what you pay for access to information, taken by our payment processor and described under "Accounts and Paid Features" below; and
• You cannot place a bet through the service, and no part of the service enables you to do so.

Any references to odds, lines, stakes, units, or track records describe analysis and the operator's own historical activity, and are not offers, invitations, or facilities to bet.

No Advice

All content on the service — including projections, model outputs, "best bets," edges, ratings, and commentary — is general information and opinion presented for entertainment. It does not take account of your personal circumstances, financial situation, or objectives.

You should not treat any content as a substitute for independent professional advice. If you require betting, financial, legal, or tax advice, consult an appropriately qualified professional.

Assumption of Risk and Responsible Gambling

Sports betting involves substantial risk of financial loss and can be addictive. If you choose to bet based on information you find here or anywhere else, you do so entirely at your own risk and are solely responsible for any losses you incur. We are not responsible for any wager you place or any outcome that results from it.

We encourage you to gamble responsibly, to bet only what you can afford to lose, and to seek help if gambling is causing you harm. Please review our Responsible Gambling resources at /responsible-gambling, which include information and links to support organizations.

Accounts and Paid Features

You can create a free account. There is no password: you enter an email address and we send you a one-time sign-in link, or you sign in with your Google account where that option is offered. Creating an account requires you to confirm that you meet the age requirements under "Eligibility and Age Requirements" above, and we record that confirmation. You are responsible for the security of the email account you sign in with — anyone who can read your email can use a sign-in link sent to it.

An account holds your email address, the date you confirmed your age, a founding-member number if it is one of the first accounts (see "Founding-Member Offer" below), and, if you buy paid access, the billing record described in our Privacy Policy (/privacy). You can delete your account yourself at any time from your account page, and doing so deletes it rather than merely deactivating it. We may suspend or close an account that breaches these Terms.

Parts of the service may be offered as paid access — a subscription or another paid plan. What you are buying is informational analytics content: projections, boards, edges and deeper access to the tools. The operator's graded public track record is not part of any paid plan — it stays free and public. You are not buying a wager, a bet slip, a betting account, or any right to place a bet, and no part of a paid plan changes the rails set out under "Description of the Service" above: we are not a sportsbook, we accept no wagers, and we never hold or move money you intend to bet.

Before you are charged anything, we will show you the price, the billing period, when and how it renews, how to cancel, and what our refund position is. You authorize that charge when you complete checkout, and nothing is charged to you that was not shown to you first. If we change the price or the billing terms of a plan you are on, we will tell you before the change takes effect and you may cancel rather than accept it.

Most of the service is free to read today, and some of what is free today will become paid. We have not announced which parts become paid or when; when we do, it will be on the site first. What is public now is a preview of that work rather than a promise that all of it stays free forever — with one exception: the graded public track record, every staked play and its result, stays free. And you will not find a page you were reading yesterday behind a paywall today without having been told.

Unless a plan says otherwise, a subscription renews automatically for successive billing periods until you cancel it, and cancelling takes effect at the end of the period you have already paid for — you keep access until then, and you are not billed again. Where a plan or a jurisdiction gives you a refund or cancellation right, the terms shown to you at checkout apply.

Payments are taken by Stripe, our payment processor. Your card details are entered on Stripe's pages, not ours; we do not receive or store your full card number. What we do receive is described in our Privacy Policy (/privacy) under "Payments and Subscriptions," and Stripe's own handling is governed by the Stripe Privacy Policy (https://stripe.com/privacy). You are responsible for keeping your billing details current and for any taxes that apply to your purchase.

Paid access is personal to you. You may not share, resell, or redistribute paid content or any credential that reaches it, and we may suspend or end access, with a pro-rated refund of any unused prepaid period where we end it without cause, as set out under "Termination" below.

Founding-Member Offer

The first 25 accounts created are founding members; the operator's own account is not counted. When paid plans launch, a founding member gets 50% off the price of any subscription plan for as long as that subscription stays active. The discount is applied automatically at checkout — there is no code — and your account page shows your founding-member number.

• One founding spot per person. It is personal to the account, cannot be transferred or sold, has no cash value, and does not combine with other discounts unless checkout says it does.
• Cancelling the discounted subscription ends the discount; a later subscription is charged at the price shown at that checkout.
• Deleting your account gives up your spot, which passes to the next account created.
• We may withdraw a spot from accounts created to take more than one, or that breach these Terms.
• The offer applies to subscriptions bought through the site's own checkout once paid plans exist. If no paid plan is ever offered, there is nothing to discount.

Acceptable Use and Prohibited Conduct

You agree to use the service lawfully and only for its intended personal, non-commercial purpose. You must not, and must not attempt to or permit others to:

• Scrape, crawl, spider, harvest, or otherwise extract data from the service by automated means without our prior written permission;
• Copy, republish, resell, redistribute, sublicense, or otherwise commercially exploit any content, models, projections, or data from the service;
• Reverse engineer, decompile, disassemble, or attempt to derive the source code, models, algorithms, or underlying methods of the service, except to the extent this restriction is prohibited by applicable law;
• Use the service for any unlawful, fraudulent, or infringing purpose, or in violation of any applicable law or regulation;
• Introduce malware or interfere with, disrupt, overload, or impair the service, its servers, or its networks, or attempt to gain unauthorized access to any system or account; or
• Remove, obscure, or alter any proprietary notices, or misrepresent your affiliation with us.

We reserve the right to investigate and take appropriate action, including restricting or terminating access, against anyone who, in our judgment, violates this section.

Intellectual Property

The service and all of its contents — including the website, software, models, projections, algorithms, data compilations, text, graphics, layout, design, logos, and trademarks — are owned by or licensed to The Sport Stack and are protected by intellectual property and other laws. All rights not expressly granted are reserved.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the service for your own personal, non-commercial use. This license does not permit any commercial use, redistribution, or creation of derivative works, and it terminates automatically if you breach these Terms.

Third-Party Data, Odds Feeds, and Links

The service incorporates or references data from third parties, including sports statistics, odds and lines from sportsbooks and odds feeds, and other external sources. It may also contain links to third-party websites and services.

We do not control and are not responsible for the accuracy, completeness, timeliness, availability, or legality of third-party data or content, and inclusion of any odds, feed, or link does not imply our endorsement, affiliation, or recommendation. Odds and lines change constantly and may be delayed or inaccurate. Your dealings with any third party, including any sportsbook, are solely between you and that third party and are subject to their own terms.

User-Generated Content

The service has no comment, profile, or other user-content features. If any are added, the rules for what you may post and the license you grant us will be set out here before they are available.

Disclaimer of Warranties

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, any statutory warranties are limited to the minimum extent permitted by applicable law.

Limitation of Liability

To the fullest extent permitted by applicable law, The Sport Stack, its operator (George Boyle, an individual based in Texas, United States), and any of their affiliates or contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or opportunity, arising out of or relating to your use of, or inability to use, the service or any content.

Without limiting the foregoing, we are not liable for any gambling or betting losses, or for any loss or damage arising from your reliance on any projection, "best bet," edge, odds, track record, or other content on the service, or from decisions you make based on it. You assume full responsibility for your use of the service.

To the extent any liability cannot be excluded, our total aggregate liability arising out of or relating to the service and these Terms is limited, at our option, to the greater of the amount you paid us (if any) for the service in the twelve months preceding the event giving rise to the claim, or one hundred US dollars (US$100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless The Sport Stack, its operator (George Boyle, an individual based in Texas, United States), and any of their affiliates or contributors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the service, your violation of these Terms or any applicable law, your infringement of any third-party right, or any bet, wager, or decision you make in connection with the content.

Modifications to the Service and These Terms

We may change, suspend, or discontinue any part of the service at any time, with or without notice, and we are not liable to you or any third party for doing so. Content, models, projections, and features may be added, modified, or removed at our discretion. If you are paying for access and we withdraw a material part of what your plan was sold as, you may cancel and we will refund the unused part of the period you have already paid for.

We may also update these Terms from time to time. When we do, we will update the effective date shown on the page. Material changes may be communicated through the service where practicable. Your continued use of the service after changes take effect constitutes your acceptance of the revised Terms; if you do not agree, you must stop using the service.

Termination

You may stop using the service at any time. We may suspend or terminate your access to the service, in whole or in part, at any time and for any reason, including if you breach these Terms or if we discontinue the service.

If you are paying for access and we end it without cause, we will refund the unused part of the period you have already paid for. If we end it because you breached these Terms — for example by sharing or reselling paid content — no refund is due. If you cancel, your access runs to the end of the period you have paid for and you are not billed again.

Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will continue to apply after termination.

Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to them or the service are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles, and subject to any mandatory consumer-protection rights available to you where you live.

Before initiating any formal proceeding, you agree to first try to resolve the dispute informally by contacting us at hello@thesportstack.io; both parties will attempt in good faith to resolve the matter within a reasonable period.

Any dispute that is not resolved informally will be brought exclusively in the state and federal courts located in Texas, and you consent to the personal jurisdiction of those courts, except where applicable law gives you the right to bring a claim in the courts of your own place of residence.

Severability and Entire Agreement

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of it.

These Terms, together with the Privacy Policy (/privacy), Cookie Policy (/cookies), and Disclaimer (/disclaimer), constitute the entire agreement between you and us regarding the service and supersede any prior agreements on that subject.
